BRAND MY BODYCARE (Hereinafter referred to as “MY BODYCARE”) is committed to respecting and safeguarding the privacy of all its service recipients and users of its website, i.e. www.mybodycare.co (Hereinafter referred to as the “Website” or “Site”). This privacy policy (Hereinafter referred to as “Policy”) discloses and enumerates the practices and policies adopted by MY BODYCARE for the purpose of collecting, storing, retrieving or using personal data and sensitive personal data or information it may be received from its users of the Website. All terms and conditions of the use of the website are incorporated in this Policy by reference. The Policy complies with the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2018 (Hereinafter referred to as “Rules”) and may be updated from time to time for the purpose of compliance.

BRAND MY BODYCARE reserves the right to modify or review the provisions in this Policy without prior notice and the revised Policy will be in effect from the day of uploading. Therefore, Users are requested and advised to periodically visit the Site and review the policy.
DEFINITIONS
“Applicable Law” means all applicable statutes, acts of Indian legislature, ordinances, rules, bye-laws, regulations, notifications, circulars, guidelines, policies, directions, directives and orders of any government, statutory authority, regulatory authority, tribunal, board or court in India;
“General Information”” will have the same meaning ascribed to it in clause 2.5 of the Policy.

“Sensitive Personal Information” shall, excluding any information that is freely available or accessible in public domain or is furnished under Applicable Laws, mean the following information:

Consequently, BRAND MY BODYCARE may share such General Information or any analysis with any third party, at its discretion.
Use of Personal Information and Sensitive Personal Information
Personal Information disclosed to BRAND MY BODYCARE by a User will be used by BRAND MY BODYCARE for one or more of the following purposes:
- To assist BRAND MY BODYCARE in creating content that is relevant to the User.
- To maintain a database of all the Personal Information collected from the User.
- To evaluate and administer the Site and resolve any problems that may arise with usage of the Sites.

User grants consent to BRAND MY BODYCARE for sharing Personal Information or Sensitive Personal Information with Persons who are associated with BRAND MY BODY CARE.
Notwithstanding anything contained in this Privacy Policy, BRAND MY BODYCARE reserves the right to disclose any Personal Information or Sensitive Personal Information that may be required to be disclosed under the Applicable Law, without prior notice or consent of the User.
DISCLOSURE TO THIRD PARTY
In case the information is being collected and retained by a third party, on behalf of BRAND MY BODY CARE, BRAND MY BODYCARE shall obtain prior permission from the User before transfer of information to any third party, only if such disclosure is necessary for compliance of a legal obligation. BRAND MY BODYCARE would be under no obligation to inform the Website Users incase such private / sensitive information is being transferred to a government agency, especially when a request for such transfer has been made by a government agency to BRAND MY BODY CARE.
BRAND MY BODYCARE E-Commerce may transfer Personal Information or Sensitive Personal Information to any company or person located in India or any other country only if it is necessary for the performance of lawful contract between BRAND MY BODYCARE and any person, provided the same level of data protection will be adhered to by the other company. BRAND MY BODYCARE cannot guarantee that such parties will keep the Personal Information or Sensitive Personal Information confidential and BRAND MY BODYCARE will not be responsible or liable in any manner what so ever for any loss caused by breach of confidentiality attributable to such third parties.

BRAND MY BODYCARE undertakes to take all reasonable measures and precautions to keep the Personal Information and Sensitive Personal Information safe and secure and to prevent any unauthorized access to or misuse of the same.
BRAND MY BODYCARE shall not be responsible or liable to any User for any loss, damage (whether direct, indirect, consequential or incidental) or harm caused to the User due to the unauthorized access or misuse of the Personal Information or Sensitive Personal Information by any third party.
LINKING TO OTHER SITES
BRAND MY BODYCARE is not responsible for the privacy practices or the Contents of any other websites for which links may be provided on the Website or which provides links to the Website. By clicking on a link, logo or other such items, or using certain services available on the Website, User may no longer be on the Website of BRAND MY BODYCARE and may be redirected to another website and in such circumstances privacy policy of such other website shall apply. BRAND MY BODYCARE encourages and advice’s users to read the posted privacy statement of the other websites whenever interacting with any website.
